Terms of Use
Last updated: 18 October 2026
1. About these terms
These Terms of Use apply to your use of markets-direct.com.au (the website), which is operated by SmartBizTech Pty Ltd (Markets Direct, we, us or our).
By using the website you agree to these terms. If you don’t agree, please don’t use the website. We may update these terms from time to time by publishing a new version here; the “Last updated” date shows when they last changed.
2. About Markets Direct
Markets Direct is a directory that connects visitors with local markets and stallholders by council area. When you search by postcode or council area, local visitors are redirected to markets in their area. Markets Direct doesn’t run the markets or sell the products listed on the website, unless we clearly say otherwise.
Listings on Markets Direct include a free version and a paid version for spotlighting (featured or promoted placement). Fees and inclusions are shown at the time of purchase.
3. Information on this website
The content on this website is general information only. Market details such as dates, times, locations, stallholders and fees are often supplied by, or based on information from, market organisers, stallholders, councils and other third parties, and can change without notice.
We work to keep the content accurate and up to date, but we don’t guarantee that it’s complete, current or free from errors.
4. Stallholders
If you’re a stallholder listed on Markets Direct, you’re responsible for:
- making sure your listing, product descriptions, prices (if shown) and market schedule are accurate and kept up to date
- any claims you make about your products, including claims about ingredients, origin, health benefits or being handmade, local or organic
- holding and complying with any licences, registrations, permits and insurance you need, including food safety and handling requirements and council approvals. Markets Direct does not require a minimum level of public liability insurance. You remain responsible for any insurance, licences and permits required by your market organiser, council or the law.
- complying with each market’s own rules and the laws that apply to your business.
You keep ownership of the photos, logos, product images and descriptions you give us. By giving them to us, you grant Markets Direct a non-exclusive, royalty-free licence to display, resize and publish them on the website, in our newsletter, blog stories and social media to promote your listing and the markets you attend. You confirm you have the right to grant that licence. You can ask us to remove them at any time.
5. Market organisers
If you’re a market organiser, or you give us details of a market, you’re responsible for:
- confirming you’re authorised to list the market, or to ask us to list it
- making sure the market name, dates, times, location, rules and contact details you give us are accurate
- telling us promptly about cancellations, rescheduled dates and changes due to weather or other circumstances, so we can update the listing.
We may also list markets using publicly available information. If you organise a market and want its listing updated or removed, email hello@markets-direct.com.au.
6. Shoppers and visitors
Markets Direct is a directory only. Any purchase you make is between you and the stallholder at the market, and is governed by the stallholder’s own terms. We don’t guarantee the quality, safety or suitability of any products, that a particular stallholder will attend, or that a market will go ahead on the date shown. Markets can change or be cancelled at short notice, including because of the weather, so please check with the market organiser before you travel.
Any questions or concerns about a product should be raised with the stallholder or the market organiser. This doesn’t affect your rights under the Australian Consumer Law, which are explained below.
7. User content, photos and stories
If you send us content, such as photos, reviews or market stories for our blog, you confirm that it’s your own work or that you have permission to share it, that it’s accurate, and that anyone clearly identifiable in a photo has agreed to it being published. You grant us a non-exclusive, royalty-free licence to edit, publish and share that content on the website, in our newsletter and on social media. We may choose not to publish content, or edit it for length and clarity.
8. Removal of listings and content
You can ask us to update or remove a listing, photo or story at any time by emailing hello@markets-direct.com.au. We may also edit, suspend or remove any listing or content, without notice, if we think it’s inaccurate, out of date, misleading, unlawful, or breaches these terms or a market’s rules.
9. Newsletter
If you sign up to our newsletter, we’ll use your details as set out in our Privacy Policy. You can unsubscribe at any time using the link in any newsletter or by emailing hello@markets-direct.com.au.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that can’t lawfully be excluded.
Where our liability for failing to meet a consumer guarantee can lawfully be limited, it is limited (at our option) to supplying the services again or paying the cost of having them supplied again.
11. Limitation of liability
To the extent permitted by law, we aren’t liable for any loss or damage (including indirect or consequential loss, or loss of profit, revenue, data or opportunity) arising from your use of, or reliance on, this website or its content, from a market being changed or cancelled, from any product bought from a stallholder, or from the website being unavailable.
12. Intellectual property
Unless stated otherwise, the content of this website, including text, graphics, logos and layout, is owned by or licensed to Markets Direct and is protected by Australian and international copyright and trademark laws. You may view and print pages for your own personal or internal business use. You must not otherwise copy, reproduce, republish or adapt our content without our written permission.
Names, logos and images of markets, stallholders and other third parties remain the property of their respective owners. All other trademarks are the property of their respective owners.
13. Third-party websites
This website links to websites run by other people, including markets, stallholders and councils. We don’t control third-party websites and aren’t responsible for their content, products, services or privacy practices. Your dealings with them are governed by their own terms.
14. Acceptable use
You agree not to use the website for any unlawful purpose, not to interfere with its security or operation, not to copy or scrape listings in bulk, and not to submit content through our forms or by email that is false, misleading, offensive or that infringes anyone’s rights.
15. Privacy
Our Privacy Policy, at /privacy, explains how we collect, use and protect personal information.
16. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that can hear appeals from them.
